Terms of service

Terms of Service

These terms help ensure a clear and transparent experience when shopping with The Perfect Carat.

01 — General Terms

These Terms of Service ("Terms") govern your use of theperfectcarat.com and your purchase of products and services from The Perfect Carat.

By accessing our website, submitting an inquiry, placing an order, or purchasing a product or service from The Perfect Carat, you acknowledge that you have read, understood, and agreed to these Terms, along with our Refund & Return Policy, Shipping Policy, and other applicable policies published on our website.

If you do not agree with these Terms, please do not use our website or purchase products or services from The Perfect Carat.

02 — Our Products

The Perfect Carat offers certified loose diamonds, lab-grown diamonds, natural diamonds, fancy colored diamonds, gemstones, engagement rings, custom jewelry, and related jewelry services.

Product descriptions, photographs, videos, measurements, certifications, availability, and pricing are provided as accurately as reasonably possible. Because diamonds and gemstones are unique, visual appearance may vary depending on photography, lighting, display settings, and the device used to view our website.

Diamond and gemstone inventory can change rapidly. Availability shown on our website is not guaranteed until your order has been confirmed and accepted by The Perfect Carat.

03 — Pricing & Availability

We make every effort to maintain accurate pricing and product information. However, errors may occasionally occur due to supplier inventory changes, technical issues, data synchronization, typographical errors, or other circumstances.

The Perfect Carat reserves the right to correct pricing, product information, or availability errors and to cancel or decline an order affected by such an error.

If your order is cancelled because of an obvious pricing or availability error, any payment received for that order will be refunded to the original payment method.

Prices may change at any time without notice until an order has been confirmed.

04 — Diamond Sourcing & Special Orders

We offer personalized diamond sourcing to help customers locate stones that meet specific preferences, including shape, carat weight, color, clarity, certification, cut characteristics, and budget.

There is no sourcing fee to request a diamond.

When a customer requests a specific diamond or gemstone, we may contact our suppliers to locate, reserve, purchase, or arrange shipment of the requested item.

Once a specially requested item has been ordered, reserved, purchased, or shipped by a supplier, cancellation may result in supplier cancellation fees, restocking charges, shipping costs, or other expenses actually incurred by The Perfect Carat.

Any applicable charges will be communicated to the customer before an applicable refund is processed.

05 — Diamond Holds & Reservations

At times, The Perfect Carat may place a diamond or gemstone on temporary hold at a customer's request.

A hold is not a completed purchase and does not guarantee indefinite availability. Hold periods are subject to availability and supplier terms.

If a customer chooses not to proceed with a held stone, the stone may be released back to inventory.

The Perfect Carat is not responsible for a stone becoming unavailable after a hold expires or if the supplier releases the stone before the customer completes payment.

06 — Custom Jewelry & Ring Studio

All custom, personalized, and made-to-order jewelry is FINAL SALE and is not eligible for return, refund, exchange, or cancellation.

This includes jewelry created through our Ring Studio / Ring Builder, as well as custom engagement rings, wedding bands, settings, personalized jewelry, made-to-order pieces, engraved jewelry, and jewelry created using customer-provided stones.

Custom jewelry is designed, sourced, and crafted specifically according to the customer's selections and specifications and cannot be returned to our standard inventory or resold as a ready-to-purchase item.

Customers are responsible for carefully reviewing all design details, including ring size, metal, stone specifications, measurements, proportions, and other selections before approving their order.

CAD & Design Approvals

CAD renderings, mockups, and design concepts are provided to allow customers to review the proposed design before production.

Customers are responsible for carefully reviewing and approving the final design before production begins.

Once a CAD design or custom design has been approved, production may begin. Changes requested after approval may result in additional costs, production delays, or may no longer be possible depending on the stage of production.

Design Deposits

Deposits paid toward CAD designs, mockups, design work, sourcing, or other custom services are non-refundable once the applicable work has begun.

Where stated on an invoice, an eligible design deposit may be applied toward the customer's final purchase.

07 — Customer-Provided Stones

The Perfect Carat may accept customer-provided diamonds or gemstones for certain custom jewelry projects at our discretion.

Customers are responsible for providing accurate information regarding any customer-owned stone.

Customer-provided stones may be subject to inspection before work begins. We reserve the right to decline a project if a stone is deemed unsuitable for the requested design, setting, or manufacturing process.

The Perfect Carat is not responsible for pre-existing damage, inclusions, treatments, structural weaknesses, or characteristics that were present in a customer-provided stone before it was received.

08 — Ring Sizing

Customers are responsible for confirming their ring size before approving a custom or made-to-order ring.

An incorrect ring size does not qualify a custom ring for a return, refund, exchange, or cancellation.

If a ring is safely resizable, resizing may be available for an additional fee. Resizing fees, shipping costs, and applicable repair or alteration charges are the responsibility of the customer.

Certain designs may not be safely resizable because of their construction, stone placement, engraving, or other design elements.

09 — Orders & Payments

Orders are not considered final until payment has been successfully received and the order has been accepted by The Perfect Carat.

We reserve the right to request additional information or verification before processing or shipping an order, particularly for high-value purchases.

If an order cannot be fulfilled due to inventory availability, supplier issues, payment verification, suspected fraud, or other legitimate circumstances, The Perfect Carat may cancel the order and issue an applicable refund.

10 — Payment Disputes & Chargebacks

Customers agree to contact The Perfect Carat directly before initiating a payment dispute or chargeback for an issue that may be resolved through our customer service process.

Unauthorized or fraudulent chargebacks may be contested using applicable order records, communications, tracking information, delivery confirmation, photographs, certificates, and other transaction documentation.

Nothing in this section limits any rights or protections available to customers under applicable law or payment-network rules.

11 — Shipping & Delivery

Shipping and delivery are governed by our Shipping Policy.

Due to the value of many of our products, certain orders may require signature confirmation, additional verification, or other security measures before shipment.

Customers are responsible for providing an accurate and complete shipping address. The Perfect Carat is not responsible for delays, additional costs, or delivery issues resulting from incorrect information provided by the customer.

12 — Returns & Refunds

Returns and refunds are governed by our Refund & Return Policy.

By placing an order, customers acknowledge that certain purchases, including custom, personalized, and made-to-order jewelry, are final sale.

The availability and operation of third-party services are outside our control. The Perfect Carat is not responsible for interruptions, errors, policies, or practices of third-party services.

16 — Limitation of Liability

To the fullest extent permitted by applicable law, The Perfect Carat will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of our website, products, or services.

Nothing in these Terms is intended to exclude or limit liability that cannot lawfully be excluded or limited under applicable law.

17 — Force Majeure

The Perfect Carat is not responsible for delays or inability to perform caused by circumstances beyond our reasonable control, including but not limited to natural disasters, severe weather, carrier disruptions, supplier delays, government actions, customs delays, labor disruptions, technology failures, or other unforeseen circumstances.

18 — Changes to These Terms

The Perfect Carat reserves the right to update or modify these Terms from time to time. Changes become effective when the updated Terms are published on our website.

Your continued use of the website following the publication of updated Terms constitutes acceptance of the revised Terms to the extent permitted by law.

19 — Governing Law

These Terms are governed by the laws applicable in the State of Texas, without regard to conflict-of-law principles, except where applicable law requires otherwise.
